The Get Information About a Merchant tool (hereinafter the “tool” may be consulted on the website of the Office de la protection du consommateur (hereinafter the “Office”) at www.opc.gouv.qc.ca/en free of charge.

This tool allows you to conduct a search among the merchants about which the Office holds information. It is not a directory of all merchants that do business in Québec.

For each merchant listed, the tool can provide you with certain information about monitoring actions taken by the Office with that merchant concerning a notice of violation, a statement of offence, a conviction, a voluntary undertaking as well as certain formal notices the merchant in question has received from consumers and of which the Office has received a copy. You can also find out other general information about that merchant, including the company’s name and address, its Québec enterprise number (NEQ), the other names under which the company operates as well as details regarding any permits, licences or exemptions it may hold (if applicable). You have the option of printing the results of your search.

Acceptance

By using the tool, you acknowledge that you have read, understand and agree to the Terms of Use herein. If you do not wish to be bound by these Terms of Use, you must discontinue using this tool.

The Office may, at its discretion and without prior notice, suspend access to the site, either temporarily or permanently, to anyone who fails to abide by the Terms of Use. In addition, the Office reserves the right to take any other appropriate actions to enforce these Terms of Use.

Amendments

The Office may amend the Terms of Use governing the use of this tool at any time and without prior notice. It is your responsibility to check whether any amendments have been made by referring to the date of the most recent update indicated on this page. Your use of the search service following any amendments means that you agree to be bound by the amended Terms of Use.

Accuracy of Information

The data contained in the tool are taken from, among other things, information reported by merchants to the Office. Each merchant is responsible for the accuracy of the information it reports to the Office. If you find that the tool contains inaccurate information, please contact us.

Restrictions

Engaging in or carrying out any of the following activities, either directly or indirectly, by any means whatsoever, is strictly prohibited:

• carrying out bulk sampling of the tool’s data;
• using the tool’s data for the purpose of aggregating information, including aggregating information containing or based on a natural person’s name or address;
• reproducing the tool, in part or in whole, for the purpose of dissemination or publication;
• using the tool’s data for lucrative purposes;
• using the tool, its content or its functionality in a manner that could damage or disable this service or compromise its performance and security.

Moreover, the Turing test (commonly referred to as “captcha”) has been implemented to prevent access to the tool by programs designed to automatically download the contact information of individuals or companies listed on the Internet.

Limitation of Liability

The Office may, at any time and without prior notice, temporarily interrupt access to the search service for maintenance purposes to ensure its proper operation, without having to grant any indemnities. Despite the ongoing efforts by the Office to ensure the proper operation of the tool, the Office shall not be held responsible for the tool’s performance.

Moreover, the Office shall not be held responsible for any interruption or suspension of this service, in particular in the event of any breakdowns, network problems, force majeure or events beyond its control, or for any damage that may result from such events.

In addition, the Office shall not be liable for any loss or damage to your computer system, including but not limited to, any loss of data, transmission of viruses, hacking attempts and piracy of data, files or programs it may contain.

Applicable Law

Any disputes concerning these Terms of Use shall be governed by the applicable laws of Québec. You therefore acknowledge the exclusive jurisdiction of the courts of Québec in this regard.
