If your cellular phone is defective, you do not have to pay for services during the repair period if:
- the phone was provided to you by the service provider when the contract was signed or during the contract’s coverage period;
- the repairs are covered by a warranty;
- the merchant did not provide you with a replacement phone free of charge during the repair period.
Applicable warranties
The law provides several warranties, including quality and a reasonable lifetime. These warranties, in accordance with the law, apply automatically and free of charge: your phone must last for a reasonable period of time under normal use. It may also be covered by a warranty offered by the merchant or the manufacturer. See the following pages for more information:
Planned obsolescence
The business of trading in goods for which obsolescence is planned is prohibited: they may not be offered, sold, rented or leased to a consumer. The obsolescence of goods is planned where a technique aimed at reducing their normal operating life is used on them.
If you believe your phone was the subject of planned obsolescence, you can file a complaint with the Office de la protection du consommateur. You can find our contact information in the Contact Us page.
