It is prohibited for a merchant to include penalty fees for being absent from a course in the language of a contract.

What if you do not show up to a course? The merchant has the right to ask you to pay for a class that has taken place. If they believe they suffered losses because of your absence, they may try to negotiate the penalty fees they will charge to you. If you cannot reach an agreement, the merchant will be responsible to take the case to court.
